These Terms of Use ("Terms") govern your use of the WiseOrator app ("WiseOrator", "the app", "we", "us"). By downloading, installing, or using WiseOrator, you agree to these Terms. If you do not agree, do not use the app.
WiseOrator is a public-speaking coaching tool. It uses your device's camera and microphone to analyze your posture, facial expressions, and speech during a practice session, entirely on your device, and shows you feedback based on that analysis. On supported devices with Apple Intelligence enabled, it may also generate AI-written coaching feedback, processed on-device.
WiseOrator is a self-practice tool, not a substitute for professional coaching, medical, psychological, or therapeutic advice. Feedback on posture, expression, or speech is generated automatically and may be inaccurate or incomplete. Use your own judgment, and consult a qualified professional for any medical or health-related concern.
WiseOrator is not directed at children under 16, and you must be at least 16 years old to use the app, consistent with the Privacy Policy.
WiseOrator does not require you to create an account. All session data is tied to the device it was recorded on and stored locally, as described in the Privacy Policy.
Session recordings you make belong to you. We do not access, view, or store copies of your recordings ourselves — they exist only in the app's private storage on your device, and you control their deletion at any time from your session history.
You agree not to use WiseOrator to record any other person without their knowledge and consent, or in any way that violates applicable law, including local wiretapping, recording-consent, or privacy laws in your jurisdiction.
WiseOrator, including its design, code, and branding, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
WiseOrator is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy of any feedback, fitness for a particular purpose, or uninterrupted operation.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of WiseOrator, including reliance on any feedback it generates.
We may update WiseOrator or these Terms from time to time. If we make material changes to these Terms, we will update the "Last updated" date above. Your continued use of WiseOrator after such changes constitutes your acceptance of the revised Terms.
You may stop using WiseOrator at any time by deleting the app, which also deletes all locally stored session data. We may discontinue the app at our discretion.
These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of WiseOrator is subject to the exclusive jurisdiction of the competent courts of Poland, except where mandatory consumer-protection laws of your own country of residence entitle you to bring a claim before your local courts instead.
WiseOrator is developed and operated by Wojciech Kulas, trading as Usługi Informatyczne Wojciech Kulas, based in Opole, Poland.
This license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to provide maintenance or support for WiseOrator. In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) — Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to WiseOrator or your possession/use of it, including product liability claims, legal compliance claims, or claims under consumer protection law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government list of prohibited or restricted parties.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
